"Modern technologies can deliver mobile services in the air safely and reliably, and the time is right to review our outdated and restrictive rules," FCC Chairman Tom Wheeler said. "I look forward to working closely with my colleagues, the FAA and the airline industry on this review of new mobile opportunities for consumers."
The FCC will collect public comment if the proposal moves forward, but opposition erupted immediately.

Oklahoma Attorney General Scott Pruitt is continuing to press for the merger of American Airlines and US Airways, telling a court in Washington, D.C., that he intends to file for “friend of the court” status for the upcoming trial in an antitrust lawsuit brought by the Justice Department.
Pruitt’s announcement Wednesday came the same day as mayors of seven cities, all with American and US Airways hubs, sent a letter to U.S. Attorney General Eric Holder asking him to withdraw the lawsuit.

Matt York/AP The U.S. Department of Justice, which is fighting a proposed merger of US Airways Group and American Airlines parent AMR Corp., asked a judge Tuesday to postpone a trial in the case, saying the federal government shutdown would prevent its staff from working. But a lawyer for the airlines said he expected the trial to determine if the government can stop the merger of US Airways and American Airlines to begin as scheduled in late November. "From what the judge said in there, and I think everybody heard, we're going to trial on Nov. 25," Richard Parker said after a pretrial hearing. "We are planning on a Nov. 25 trial date." Judge Colleen Kollar-Kotelly didn't mention a potential stay during the pretrial hearing Tuesday. Shares of US Airways (LCC) were up 3.5 percent at $19.63 in midday trading Tuesday, while AMR (AAMRQ) rose 9.5 percent to $4.50. The Justice Department had asked for the stay because of a government-wide shutdown that started Tuesday. "This is creating difficulties for the Department to perform the functions necessary to support its litigation efforts," the department said in a court filing. The Justice Department and several states sued Aug. 13 to stop the merger, saying the deal to create the world's biggest carrier would lead to higher fares and stifle competition. Parker said a settlement resolving the fight was still possible. "We are interested in a reasonable settlement in this case," he said. Any settlement would mean asset sales, which in turn would require approval from the judge overseeing American's emergence from bankruptcy. The airlines have defended the deal in court filings, saying it would create $500 million in savings to consumers annually by creating a stronger competitor to Delta Air Lines Inc and United Continental Holdings Inc. I ran a subjective screen of the companies in IYT, using the following criteria:
First, I eliminated the airline stocks. I would never own an airline stock individually: they have a long tradition of providing poor returns for their shareholders. A glimpse at a few ten year charts for component airlines like Delta (DAL), Jetblue (JBLU), Southwest (LUV) and United Continental Holdings (UAL) shows a lot of volatility and pitiful gains. The exact opposite of what investors should be looking for. Furthermore they are oil price sensitive: a more efficient way to trade this is an oil ETF. And yes, they are becoming more efficient with newer engines, but Boeing (BA) is a more efficient way to trade that issue. Second, I looked for companies that have shown (nearly) uninterrupted earnings growth since the recession ended in 2009. Sure maybe a soft quarter here and there; but solid growth. If the issue was a bit in doubt I turned to the company's ten year record, and insisted if growth was negative during the recession, it recover swiftly afterward and share net go on to new highs. finally, I wanted the company's trailing PE ratio to be near the bottom of its ten year range.Yes, these screen criteria are more subjective than a pure computer screen would be, but this leaves room for investor analysis and judgment, which never should be off the table when making an investment.
